What is Form 1099-NEC?

Form 1099-NEC (Nonemployee Compensation) is the form a business uses to report what it paid an independent contractor, freelancer, or other non-employee during the tax year. The payer sends Copy A to the IRS and Copy B to the contractor, who uses it to report that income on their own return. It was reintroduced in 2020 to split nonemployee pay out of the 1099-MISC. Starting in 2026, the reporting threshold rises from $600 to $2,000 under the One Big Beautiful Bill Act, but any amount you pay a contractor is still taxable income to them.

Who needs to fill out Form 1099-NEC?

Any business or individual that paid a non-employee $2,000 or more (the 2026 threshold) for services during the year files a 1099-NEC for that contractor. The payer prepares and files it; contractors receive the form but do not file it themselves.
You generally don't issue a 1099-NEC for payments to most corporations, for personal (non-business) payments, or for amounts paid through a card or third-party network, which are reported on Form 1099-K instead.
